Terms and Conditions - Legal Jobs Centre

These terms and conditions apply to all users of the Legal Jobs Centre website at www.legaljobscentre.com.au provided by Key Media Pty Ltd.

Please read these terms and conditions carefully before accessing or using the information and services available on Legal Jobs Centre. By accessing or using Legal Jobs Centre you agree to be bound by these terms and conditions.

If you are an advertiser, recruiter or employer on Legal Jobs Centre, the terms of your sales agreement with Key Media Pty Ltd will also apply in relation to your use of services provided by Legal Jobs Centre.

Key Media Pty Ltd may modify these terms and conditions from time to time and you should review them regularly. If Key Media Pty Ltd makes a material change to these terms and conditions we will notify you by placing a prominent notice on our homepage or by directly sending you a notification.

Your continued use of Legal Jobs Centre and our services constitutes your agreement to these terms and conditions and any modifications to them.

 

1. Intellectual Property

All intellectual property rights (including but not limited to copyright and trademarks) relating to the information and other material appearing on Legal Jobs Centre vest in and are the exclusive property of Key Media Pty Ltd and its licensors. You may only access, use and print the information and material on Legal Jobs Centre for non-commercial or personal purposes and you must keep intact all copyright and proprietary notices. You must not otherwise reproduce, adapt, store, transmit, print, display, commercialise, publish or create derivative works from any part of the content, format or design of Legal Jobs Centre.

If Key Media Pty Ltd permits you to advertise on Legal Jobs Centre you grant Key Media Pty Ltd an irrevocable, permanent and royalty free licence to use any advertisement that has been submitted by you for placement on Legal Jobs Centre or any other third-party website deemed reasonable by Key Media Pty Ltd for the express purpose of generating user views and job applications. You may not and must not allow or permit other parties on your behalf to copy advertisements, or to undertake site scraping or other similar activities unless you have obtained the prior, express permission of Key Media Pty Ltd.

 

2. Privacy Policy

If you choose to provide us with personal information as part of your use of Legal Jobs Centre (including your resume or curriculum vita (CV)), this information will be managed in accordance with our Privacy Policy.  You are urged to read our Privacy Policy before you use the Legal Jobs Centre website.

 

3. Acceptable Use

You agree that during your use of Legal Jobs Centre you will not intentionally make representations that are misleading or false.  Your use of Legal Jobs Centre shall be for personal or professional purposes only and you will not use Legal Jobs Centre to store, send, distribute or publish any offensive information or make unsolicited contact.

Advertisers, recruiters and employers agree that:

(a) They will not post ads that cosmetically refresh and reposition at the top of search listings. This includes posting duplicates of the same position on the same day, consecutive days, or within a calendar week.

(b) They will only list one job position per advertisement unless otherwise agreed.  Key Media Pty Ltd reserves the right to individually charge for any multi job listings that appear within the same advertisement.  Key Media Pty Ltd further reserves the right to remove any advertisements that are in breach of this policy. 

(c) Unless otherwise agreed, they will only include branding on Legal Jobs Centre that represents the entity with whom Key Media Pty Ltd has a contractual arrangement.

(d) Unless otherwise agreed, they will only have branding representation on the website in the categories in which they post job content in a calendar month.

(e) They may only use an external application link where this link directly takes the applicant to a definitive application form.

(f) They must not include their company/recruiter name, or job reference number, in the title of a job posting. Any references will be subsequently removed from posting/s. They must also not use foreign characters or CAPS in the title of a job posting.

At all times Key Media Pty Ltd reserves the right to remove or amend ads which breach any of the above conditions.

 

4. Legal Jurisdiction

These terms and conditions and your use of Legal Jobs Centre will be governed by the laws of the State of News South Wales, Australia.  You and Key Media Pty Ltd submit to the non-exclusive jurisdiction of the courts of that State and the courts of appeal from them.  You will not object to the exercise of jurisdiction by those courts on any basis.

 

5. Liability

You agree that Key Media Pty Ltd will not be liable for any damages or liability whatsoever that may arise as a result of your use of Legal Jobs Centre or other services.  Key Media Pty Ltd hereby also excludes any warranties as to the accuracy, quality and validity of any of Legal Jobs Centre contents, including resumes, curriculum vita or other information submitted by users of Legal Jobs Centre in response to advertisements.  Nothing in this section limits or excludes any non-excludable rights that you may have under statute, such as the Trade Practices Act 1974 (Cth).

 

5.1 Service availability and performance: Key Media Pty Ltd gives no guarantee as to the availability and performance of Legal Jobs Centre. Accordingly, Legal Jobs Centre is provided by Key Media Pty Ltd on an 'as and when available' basis. Further, where Key Media Pty Ltd provides links to external websites maintained by third parties, Key Media Pty Ltd gives no guarantee or endorsement as to the services operated by those websites.

 

5.2  Site security: While Key Media Pty Ltd takes reasonable steps to ensure that information provided to it by users via Legal Jobs Centre is maintained securely, and in accordance with its Privacy Charter, it accepts no responsibility for breaches of security or unauthorised access that arise as a result of disclosure by Users of their login details, username or password.  You will remain responsible, at all times, for maintaining the confidentiality of your login details, username and password and Key Media Pty Ltd accepts no liability for the misuse of these details.

While Key Media Pty Ltd also takes reasonable steps to ensure Legal Jobs Centre is virus free, you acknowledge that accessing Legal Jobs Centre is done at your own risk. This also includes, but is not restricted to, any monetary or other loss that may result from loss or corruption of data, downtime or hardware damage.

 

5.3 Job and position advertisements: Key Media Pty Ltd provides no guarantee as to the accuracy or availability of any specific job that may be advertised on Legal Jobs Centre. You should be aware that parties that advertise on Legal Jobs Centre may have already filled the position in an advertisement even though it still appears on Legal Jobs Centre.

Key Media Pty Ltd also cannot guarantee that any advertisement placed on Legal Jobs Centre will attract applications from users, or that any advertisement placed on Legal Jobs Centre will lead to the placement of a successful candidate in an advertised position.

 

5.4 Indemnity: You will at all times indemnify and will continue to indemnify, hold harmless and defend Key Media Pty Ltd, its related bodies corporate and their respective personnel (in this section, "those indemnified") from and against all liabilities, costs, damages, expenses, claims, suits, allegations and demands, including, without limitation, all legal fees (incurred on a solicitor and own client basis), arising out of or in relation to:

(a) Any infringement, or claim or allegation of infringement, of the intellectual property rights or any other proprietary rights of a third party; and

(b) Any fraud, deliberate or wilful misconduct or negligence or breach of these terms and conditions committed by you.

 

6. Right of Refusal Withdrawal and Amendment

Key Media Pty Ltd retains the right to refuse, withdraw or require to be amended any information submitted via Legal Jobs Centre, or any advertisement placed on Legal Jobs Centre, that Key Media Pty Ltd deems to be illegal, misleading, offensive or in any other way inappropriate or unsuitable.

 

7. Payment And Suspension

Payment and invoice terms for placement of job advertisements or other services will be made according to the terms specified in the agreement Key Media Pty Ltd enters with you in relation to its services. 

Key Media Pty Ltd at all times reserves the right to suspend or close accounts at its absolute discretion in the event of, but not limited to, non-payment of advertisements or breaches of these Terms and Conditions.
