JOB DETAILS

As Tyco International continues to grow its diverse businesses in Asia, it also continues to require an experienced attorney to work within the Tyco law department in Asia to assist in drafting, revising and instituting proper controls, educational materials and in providing guidance to its businesses’ questions on compliance-related topics.  This role is responsible for advising the Asia Region's business units in the area of compliance with local and international laws and regulations for anti-bribery, trade compliance, unfair competition, and corporate governance. 


 


Reporting to the General Counsel, Asia and based in Singapore, the Regional Compliance Counsel will work to assist Tyco businesses based in the Asia region in compliance and litigation and commercial requirements as necessary.  The position will also have a dotted line reporting relationship to the US-based Vice President and Chief Counsel of Compliance & Regulatory Affairs.


 


Specific elements of responsibilities include:


 



  • Working with the Tyco law department and compliance team to manage and deploy Tyco’s compliance policies, programs, and practices within Tyco’s Asia-based businesses. 

  • Effectively liaising with external counsel and governmental agencies/regulators to facilitate the success of Tyco Compliance initiatives.

  • Working as a key member of the legal leadership team in Asia to help set the direction of Asia-based initiatives in support of business goals.  This includes providing leadership support, positive motivation and individual contribution to aid in the success of the corporate legal team in Asia and effectively influencing and supporting business leadership. 

  • Training for internal and external parties on the ins/outs, do's/don'ts of various company policies and procedures, local laws and regulations, and international laws and regulations, including, but not limited to, the United States Foreign Corrupt Practices Act (FCPA).  In this connection, the individual must be comfortable in public speaking and conducting questions/answer sessions.  He/She will need to manage such open-question formats well and be persuasive in their presentation and logical flow.  He/She will also need to write well/persuasively for such engagements as well as in letters to regulators.

  • Answering day to day questions from business managers and field employees.  This includes areas of distribution/shipping compliance.  The person must be able to prioritize various work requirements to ensure items are properly taken care of.

  • Providing briefings and executive summaries orally and in writing to senior management. 

  • Writing reports to management, both in the region and in the U.S. 

  • Conducting internal investigations.  This includes working with the Tyco forensic audit and internal audit teams, and H/R staff, among others.  The candidate must have a good sense of how to get at the truth of a situation and be able to ask questions, review documentation effectively, piecing together various data into a logical understanding and writing up the results in a coherent and logical report. Investigation areas may include anti-bribery/FCPA, international trade compliance (import/export), anti-trust/competition laws, employee right to privacy, among others.


 


Work Hours:


Work hours may be in excess of 40 hours per week in order to meet the goals of the role and businesses.


 


Travel: 50%


Because Tyco’s operations in Asia are located in over 15 different countries, a fair amount of travel (up to 50%) around the region is anticipated, including longer trips to Korea, Japan and northern China and shorter, day-trips to Indonesia, Malaysia and Thailand.  Travel may also include trips to the US and/or Europe for annual Legal team meetings.


 


Experience:



  • Law degree from a recognized university.

  • Approximately 8+ years qualified experience as an external counsel, prosecutor or in-house counsel specializing in compliance work.

  • All industry experience will be considered.


 


Candidate Capabilities:



  • Fluency in English (written and oral) required with additional language skills in Korean, Japanese and/or Chinese, preferred.

  • Strong communication skills including business writing skills, the ability to communicate in a succinct and coherent way and presentation skills.

  • Informing skills, to ensure message alignment and understanding of risks and opportunities.

  • Strong influencing skills and the ability to work through ambiguous situations with little guidance.

  • Solutions and action-oriented.
